Age Requirements

The Service is available only to individuals who are at least 16 years old. You represent and warrant that if you are an individual, then you are of legal age to form a binding contract, and that all registration information you submit is accurate and truthful. Circate may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.

Your relationship with Circate

These terms aim at articulating the relationship between you and Circate. If you agree to these terms, then we give you permission to use our services. When we refer to “Circate,” “we,” “us,” and “our,” we mean Circate Media Corporation and its affiliates (if we happen to have any).

What you can expect from us

Circate is an online venue system for creators that provides the followings services that are subject to these terms:

We aim for perfection while recognizing that it is likely unattainable. Yet we strive for it nonetheless by doing our best. Accordingly, we are actively developing our venue system and seeking to add new features and to improve upon existing ones, where possible.

If we need to make any big changes or stop offering any of our services, we will do our best to give you some heads up.

What we expect from you

The permission we give you to use our services continues as long as you comply with these terms.

You also agree with our Privacy Policy, which can be found on our website.

Although we give you permission to use our services, we retain any intellectual property rights we have in the services.

Be cool

We really want Circate to be a place people love. We want it to be a place where you can

So. Seriously. Don’t be mean to people. If we find out about it, you’re out.

Obey the applicable laws.

Respect the rights of others, including privacy and intellectual property rights.

Don’t do harm to anyone: for example, by misleading, defrauding, illegally impersonating, defaming, bullying, harassing, or stalking others.

Don’t disrupt our services.

Be honest

Don’t submit links to works you didn’t create and/or don’t own the rights to.

Be original

We know there are ways to offer unique interpretations of existing works, but go do it somewhere else. Our services are for original works only. No cover songs, remakes, deliberately derivative works, no fan fiction, etc.

This also means that we do not accept or allow works created by AI systems. No. Generative. AI. Works. Allowed.

Be clean

We want people to be able to have a clean fun experience here. Accordingly, we do not permit you to share links to content that is explicit, vulgar, pornographic/sexually explicit. Go somewhere else if that’s what you’re interested in.

Absolutely nothing illegal.  

No fake accounts


We do not permit fake accounts or bots to run on our site. Unlike platforms such as YouTube, or Spotify, bot accounts and fake accounts aren’t really going to help you much here anyway.

Permission to use your content

Circate services are designed around links to your content. That’s really all the content of yours our site has - a link to a site that does host your content (writing, game, music, video). You have no obligation to enter a tournament with a link to your content. If you choose to, please make sure you have the rights to do so and that the content is lawful and in line with the terms of this agreement.

Warranty disclaimer

We work hard to make sure everything works. But we lack the sovereignty of God, so it’s possible a few things are outside of our purview or control. Meaning, you get our best efforts and we offer no warranties. This is an as-is deal. Apparently we gotta use some legal mumbo jumbo to explain this, as follows:

TO THE EXTENT ALLOWED BY APPLICABLE LAW, WE PROVIDE OUR SERVICES “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FOR EXAMPLE, WE DON’T MAKE ANY WARRANTIES ABOUT THE CONTENT OR FEATURES OF THE SERVICES, INCLUDING THEIR ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS.

Liabilities

For all users

Both the law and these terms try to strike a balance as to what you or Circate can claim from the other in case of problems. That’s why the law allows us to limit certain liabilities — but not others — under these terms.

These terms only limit our responsibilities as allowed by applicable law. These terms don’t limit liability for gross negligence or willful misconduct.

To the extent allowed by applicable law:

Taking action in case of problems

Before taking action as described below, we’ll provide you with advance notice when reasonably possible, describe the reason for our action, and give you an opportunity to fix the problem, unless doing so would:

Removing your content

If any of your content (1) breaches these terms, (2) violates applicable law, or (3) could harm our users, third parties, or Circate, then we reserve the right to take down some or all of that content in accordance with applicable law. Examples include child pornography, content that facilitates human trafficking or harassment, terrorist content, and content that infringes someone else’s intellectual property rights.

Suspending or terminating your access to Circate services

Circate reserves the right to suspend or terminate your access to the services or delete your Circate Account. Particularly if any of these things happen:

Settling disputes, governing law, and courts

Tennessee law will govern all disputes arising out of or relating to these terms, regardless of conflict of laws rules. These disputes will be resolved exclusively in the federal or state courts of Tennessee, USA and you and Circate consent to personal jurisdiction in those courts.

About these terms

By law, you have certain rights that can’t be limited by a contract like these terms of service. These terms are in no way intended to restrict those rights.

These terms describe the relationship between you and Circate. They don’t create any legal rights for other people or organizations, even if others benefit from that relationship under these terms.

If it turns out that a particular term is not valid or enforceable, this will not affect any other terms.

We may update these terms (1) to reflect changes in our services or how we do business — for example, when we add new services, features, technologies, pricing, or benefits (or remove old ones), (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm.

If we materially change these terms, we’ll provide you with reasonable advance notice and the opportunity to review the changes, except (1) when we launch a new service or feature, or (2) in urgent situations, such as preventing ongoing abuse or responding to legal requirements. If you don’t agree to the new terms, you should contact us to remove your content and stop using the services. You can also end your relationship with us at any time by contacting us so we can close your account.
